Hernandez v. Stoffer

District Court of Appeal of Florida, Third District
Jul 7, 1999
736 So. 2d 151 (Fla. Dist. Ct. App. 1999)

Opinion

No. 98-746.

Opinion filed July 7, 1999.

An Appeal from the Circuit Court of Dade County, Robert P. Kaye, Judge, L.T. No. 96-17298.

Parenti, Falk, Waas, Hernandez, Cortina and Gail Leverett Parenti, for appellants.

Deutsch Blumberg and James C. Blecke; Osherow Schwartz and Mark R. Osherow and Kenneth J. Schwartz, (Boca Raton), for appellee.

Before LEVY, GODERICH, and FLETCHER, JJ.

Because the plaintiff's expert witness' testimony created a conflict in the evidence, the trial court properly denied the defendants' motions for directed verdict. See Lawrinson v. Bartruff, 600 So.2d 22 (Fla. 2d DCA 1992). Further, as to the remaining points raised by the defendants, we find that they lack merit. As such, we affirm the final judgment under review.

Affirmed.
