NESTOR HERNANDEZ, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the Criminal District Court No. 7 Dallas County, Texas Trial Court Cause No. F22-44634

ORDER

NANCY KENNEDY JUSTICE

Appellant's brief is overdue. The brief was originally due April 25, 2024. After granting appellant's appointed counsel, Valencia Bush, multiple extensions of time to file the brief, the Court abated the appeal on October 10, 2024, for the trial court to make findings concerning Ms. Bush's failure to file the brief. The trial court held the hearing on October 25, 2024, and Ms. Bush told the trial court, "I will need another 30 days, which will be my last request for extension." She told the trial court she had begun work on the brief. On October 30, 2024, this Court ordered Ms. Bush to file appellant's brief on or before November 25, 2024. As of the date of this appeal, appellant's brief has not been filed.

We ORDER Ms. Bush to file appellant's brief and a motion for extension of time to file the brief no later than DECEMBER 23, 2024. If appellant's brief and motion for extension of time to file the brief are not filed by that date, the Court may order Ms. Bush removed from representing appellant and abate the appeal for the trial court to appoint counsel for appellant.
