Appellant's brief is overdue. The record was filed May 10, 2024, and appellant's brief was due June 10, 2024. On June 11, 2024, this Court notified appellant's counsel, Valencia Bush, that appellant's brief was overdue and directed her to file appellant's brief and a motion for extension of time to file the brief within ten days. On July 10, 2024, this Court ordered Ms. Bush file appellant's brief and a motion for extension of time to file the brief by July 25, 2024. On July 11, 2024, Ms. Bush filed a motion for extension of time to file the brief, requesting an extension through August 20, 2024. This Court granted the motion to the extent that we ordered Ms. Bush to file appellant's brief by August 9, 2024. However, as of the date of this order, which is after August 20, 2024, Ms. Bush has not filed appellant's brief.
We ORDER Ms. Bush to file appellant's brief and a motion for extension of time to file the brief on or before SEPTEMBER 6, 2024. We caution Ms. Bush that if appellant's brief and the motion for extension of time to file the brief are not filed by that date, the Court may abate the case for the trial court to make findings in accordance with Rule of Appellate Procedure 38.8(b)(2). See Tex. R. App. P. 38.8(b)(2).
