NESTOR HERNANDEZ, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the Criminal District Court No. 7 Dallas County, Texas Trial Court Cause No. F22-44634

ORDER

NANCY KENNEDY JUSTICE

Appellant's brief is overdue. Appellant's brief was originally due April 25, 2024. On June 13, 2024, this Court ordered appellant's counsel, Valencia Bush, to file appellant's brief by June 28, 2024. On June 17, 2024, Ms. Bush moved for an extension of time to file appellant's brief requesting an extension through August 15, 2024. This Court granted the motion to the extent that we ordered Ms. Bush to file the brief by July 19, 2024. As of the date of this appeal, which is after August 15, 2024, appellant's brief has not been filed.

We order Ms. Bush to file appellant's brief on or before SEPTEMBER 5, 2024. If appellant's brief and motion for extension of time to file the brief are not filed by that date, this appeal may be abated for the trial court to make findings in accordance with Rule of Appellate Procedure 38.8. See Tex. R. App. P. 38.8(b)(2).
