ORDER

PER CURIAM

Pursuant to Tex.R.App.P. 10.4 (a) the motion ruled on through this Order may have been decided by a single Justice sitting on the panel.

The Court GRANTS the court reporter's second request for an extension of time to file the reporter's record until June 5, 2024. Absent extraordinary circumstances, no further requests for extension will be considered by the Court. The reporter's record is now due to be filed on or before June 5, 2024.

If reporter Wendy L. Kirby does not file the reporter's record by June 5, 2024, this Court will take further action to protect the parties' rights, which may include abating the cause and remanding to the trial court for a hearing to determine if another reporter should be assigned to complete the record in this cause, filing a report with the Judicial Branch Certification Commission, the regulatory agency overseeing Certified Court Reporters, issuing a show-cause order requiring Wendy L. Kirby to appear in person before this Court, or issuing an order of contempt finding Wendy L. Kirby in contempt for failing to file the reporter's record in a timely manner.

IT IS SO ORDERED.
