On July 26, 2023, respondent filed a Motion to Dismiss for Failure to Properly Prosecute. Although the Court directed petitioner to file an objection, if any, to respondent's motion to dismiss, petitioner failed to do so.

Upon due consideration and for cause, it is

ORDERED that this case is assigned to Judge James S. Halpern, solely for the purposes of disposing of respondent's Motion to Dismiss for Failure to Properly Prosecute. It is further

ORDERED that respondent's Motion to Dismiss for Failure to Properly Prosecute is calendared for hearing during the Court's March 4, 2024, El Paso, Texas, trial session scheduled to commence at 10:00 a.m., in District Court Courtroom #622, 6th Floor, Armendariz Sr. U.S. Courthouse, 525 Magoffin Avenue, El Paso, Texas 79901.
