ORDER


This case is before the Court upon Petitioner Floyd J. Hernandez's "Motion for Equity in Review" filed October 30, 2002. In the motion, Hernandez requests that he be given 30 days to respond to Respondent Janie Cockrell's answer to his federal habeas corpus petition. Cockrell filed an answer to Hernandez's federal habeas corpus petition on October 24, 2002; thus, under the terms of the August 29, 2002 show cause order Hernandez has until November 25, 2002 to file a response to the answer. Further Hernandez timely filed his reply to Cockrell's answer on November 15, 2002. Accordingly, it is ORDERED that the motion is DENIED as moot.

Because the 30th day after Cockrell filed her answer falls on a Saturday, the due date for any response is set for the next Monday — November 25, 2002. FED. R. Civ. P. 6(a).
