ORDER DENYING DEFENDANT'S MOTION FOR SUMMARY JUDGMENT


Defendant Deseret Mutual Benefit Administrators' Motion for Summary Judgment came on for hearing in front of this Court on Tuesday, the 8th day of April, 2003. Plaintiff was represented by Erik Strindberg of the law firm STRINDBERG SCHOLNICK, LLC. Defendant was represented by Eric Olson of the law firm KIRTON McCONKIE. Having heard oral argument, and considered the memoranda submitted by the both parties, and for good cause appearing

IT IS HEREBY ORDERED as follows:

I. There are material facts in dispute, in particular what is meant by the terms "benefits"; and

2. Therefore, Defendant's Motion for Summary Judgment is hereby denied.
