McMILLAN, Judge.

Pursuant to the Alabama Supreme Court's decision in Ex parte Hergott, 588 So.2d 911 (Ala. 1991), the judgment is reversed and this cause remanded to the trial court for proceedings in accordance with that opinion.

REVERSED AND REMANDED.
