CODY HARRIS HERD, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 59th Judicial District Court Grayson County, Texas
Trial Court Cause No. 070022

ORDER

Before the Court is appellant's June 18, 2020 motion for extension of time to file his brief. In the motion, appellant states that portions of the reporter's record (pretrial evidentiary hearings) have not been filed. According to appellant, he contacted the court reporter on June 7, 2020 and requested a supplemental reporter's record of the hearings.

An appellant's brief is due thirty days after the date the record is filed. TEX. R. APP. P. 38.6(a). It follows that a brief cannot be due if portions of the record have not been filed.

We ORDER official court reporter Charla Reamy to file a supplemental reporter's record containing the pretrial evidentiary hearings, requested by appellant on June 7, 2020, by July 1, 2020.

Appellant's brief is due thirty days after the date the supplemental reporter's record is filed. Appellant's June 18, 2020 extension motion is DENIED as premature.
