DECISION AND ORDER ON MOTION

Motion for reargument.

Motion to appoint guardian ad litem or to be relieved as counsel.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED that the motion for reargument is granted, without costs, to the extent that the time to perfect the appeal is extended to April 25, 2013, and it is further

ORDERED that the motion to appoint a guardian ad litem is denied, without costs and without prejudice to a motion for such relief being made in the court where the action was triable (see CPLR 1202 [a]), and it is further

ORDERED that the motion by Cheryl Parsons Reul, Esq., to be relieved as attorney for defendant is granted, without costs, and no further proceedings shall be taken until February 25, 2013 and this order shall be mailed to defendant by the Clerk of this Court and shall constitute notice to defendant to appoint another attorney under CPLR 321 (c) or to proceed representing herself on the appeal.
