ABATEMENT ORDER

Pursuant to this Court's June 6, 2024 Abatement Order, Patrick D. Sullivan, counsel for appellee Jeanne Manry Welch, Trustee of the Welch Manry Family Trust, has filed a status report advising the Court that the parties need additional time to finalize the remaining settlement documents and present an Agreed Motion to this Court. Appellee's counsel states that, on or about July 16, 2024 the parties met with the mediator/arbitrator to work through final issues and with her assistance completed and executed formal settlement papers. Appellee's counsel further states that pursuant to those papers, a few additional steps need to be completed, including filing an agreed motion to handle the disposition of this appeal, and that the parties are in the process of drafting those papers and taking those steps. Appellee's counsel states that he has conferred with appellant's counsel, Steven J. Knight, and that he agrees to the statements and to a sixty-day extension of the abatement period. The parties therefore request that the abatement of this case continue for an additional sixty days while the parties finalize the remaining documents. The parties' request to continue the abatement of this appeal is GRANTED.
Accordingly, we continue the abatement of this appeal for an additional sixty days from the date of this order. No later than 60 days from the date of this order, the parties shall file a motion to reinstate and dismiss the appeal, a motion to reinstate and proceed with the appeal, or a report advising this Court of the status of the proceedings. If the parties do not respond as directed, this Court, on its own motion, may reinstate this case on the active docket. The appeal remains abated, treated as a closed case, and removed from this Court's active docket.
