Order granting defendant's motion for judgment dismissing the amended complaint, under rule 106 of the Rules of Civil Practice, for insufficiency, unanimously affirmed, with twenty dollars costs and disbursements, with leave to the plaintiff to serve a further amended complaint within twenty days after service of order upon payment of said costs. No opinion.
