It is Ordered that the motion and cross motion are consolidated for disposition.

It is further Ordered that the motion of plaintiff-respondent to dismiss the consolidated appeals is denied.

It is further Ordered that the motion of defendants-appellants seeking to enlarge the time to perfect the appeal is granted on condition that defendants-appellants perfect its appeal by no later than the November 2016 term the filing deadline for which is September 13, 2016. In the event of defendants-appellants failure to comply with the foregoing condition, plaintiff-respondent may move, on five days' notice, for an order dismissing the appeal.
