The judgment of dismissal and the decision of the medical malpractice tribunal in favor of the defendant are vacated; the decision is to be replaced by a new finding and decision that the plaintiff's offer of proof as to the defendant is sufficient to raise a legitimate question of liability appropriate for judicial inquiry.
