Henry v. Henry

Court of Appeals of Texas, Fifth District, Dallas
Aug 20, 2008
No. 05-08-00283-CV (Tex. App. Aug. 20, 2008)

Opinion

No. 05-08-00283-CV

Opinion Filed August 20, 2008.

On Appeal from the 302nd Judicial District Court, Dallas County, Texas, Trial Court Cause No. 06-04458-U.

Before Justices FITZGERALD, RICHTER and LANG-MIERS.

MEMORANDUM OPINION

On May 27, 2008 the Court notified the court reporter the court reporter's record was overdue. In response, the court reporter notified the Court that appellant had not paid for the reporter's record and that appellant informed the court reporter she was not certain she wanted to proceed with her appeal.

By order of June 17, 2008, we notified appellant that due to the lack of a request of the reporter's record, this case would be submitted on the clerk's record alone. We further notified appellant her brief was due July 17, 2008. Alternatively, we advised that if she no longer wished to proceed with this appeal, appellant was to file a motion to dismiss the appeal by June 27, 2008. Appellant did not file a motion to dismiss the appeal or her appellant brief by June 27, 2008. By order of July 31, 2008, we ordered appellant to file her brief by August 10, 2008. We advised appellant that if her brief was not filed by that deadline, the appeal would be dismissed without further notice.

Appellant has not filed her brief. We DISMISS this appeal for want of prosecution. See Tex. R. App. P. 42.3(a), (c).
