ORDER

DAVID GUSTAFSON JUDGE

By this order we will resolve several pending motions. This order does not resolve petitioner's motion to strike (Doc. 436).

This case was scheduled for trial during the Court's Washington, D.C., session beginning December 13, 2021, and the Court set the case for trial at a date and time certain of 9:00 a.m. on December 14, 2021, at the Court's courthouse in Washington, D.C. When the case was called during the calendar call on December 13, 2021, the Court and the parties discussed the status of the case. During the calendar call the Court determined to grant a continuance of trial that will be scheduled for a future date, but determined that the case will nonetheless be called on December 14, 2021, as noticed, but for a pretrial hearing rather than a trial. Because the trial of this case will take place in the future, we will deny without prejudice the Commissioner's two motions in limine (Docs. 293 and 435).

It is

ORDERED that Mr. Henry's motion for a continuance is granted, in that this case is stricken for trial from the session that began December 13, 2021, except that the undersigned judge retains jurisdiction. It is further

ORDERED that a pretrial hearing will be held in the case at 9:00 a.m. on December 14, 2021, at the time and place previously noticed for trial. It is further

ORDERED that the Commissioner's two motions in limine (Doc. 293 and 435) are denied without prejudice.
