ORDER

On October 21, 2021, the Court ordered (1) a document subpoena hearing set for November 17, 2021 and (2) that "no later than November 15, 2021, petitioner shall file a status report advising the Court whether the third party has complied with the subpoena and a hearing is no longer necessary. Petitioner served the subpoena for records to Florida Blue and to the U.S. Department of Health and Human Services Health Insurance Marketplace (HHS). Petitioner filed a status report on November 12, 2021 informing the Court that Florida Blue has complied with the subpoena. However, more information is still needed from HHS. HHS has requested additional authorization and consent from petitioner before releasing responsive document, however, due to a death in petitioner's family, petitioner's counsel was unable to obtain and return the requested signed authorization and consent until November 11, 2021. The status report asks the Court to reschedule the hearing for a later date to give HHS the opportunity to adequately respond to the document subpoena.

Upon due consideration and for good cause shown, it is

ORDERED that this case is hereby stricken from the Special Hearing Session of the Court scheduled to begin at 1:00pm EST on Wednesday, November 17, 2021.
