Opinion
June 29, 1943.
Present — Crosby, P.J., Cunningham, Taylor, Dowling and Harris, JJ.
Order entered May 3, 1943, affirmed. Order entered February 8, 1943, so far as appealed from, modified in the following particulars: the second ordering paragraph is modified so as to allow the plaintiff $300 per month alimony; by striking out the third ordering paragraph; the fifth ordering paragraph is modified by increasing the allowance for counsel fees to $300. As modified the order is affirmed, with ten dollars costs and disbursements to the appellant. All concur. (The portion of the order entered February 8, 1943, appealed from denies plaintiff costs upon her application for judgment; denies plaintiff's motion to increase her alimony; allows plaintiff counsel fees; and grants defendant's cross motion to reduce the alimony. The order entered May 3, 1943, denies plaintiff's motion for counsel fees for prosecution of an appeal from the previous order.)
