ROBERT D. BURNS, III, CHIEF JUSTICE

Before this Court is the State's February 14, 2024 agreed motion requesting, we abate this case to the trial court to make findings of facts and conclusions of law related to the trial court's April 4, 2023 denial of appellant's motion to suppress. We GRANT the State's motion and ORDER the trial court to make written findings and conclusions of law regarding the denial of appellant's motion to suppress.

The trial court shall file a supplemental clerk's record containing the court's written findings and conclusions of law pursuant to this order within THIRTY DAYS of the date of this order.

We DIRECT the Clerk to send copies of this order to the Honorable Tom Nowak, Presiding Judge, 366th Judicial District Court Collin County, and counsel for all parties.

This appeal is ABATED for the trial court to comply with the above order. The appeal will be reinstated when the supplemental clerk's record containing the trial court's findings and conclusions are received or at such other time as the Court deems proper.
