Plaintiff, Dustin Henderson, filed an Amended Prisoner Civil Rights Complaint on February 8, 2022. Defendant Flora Stowater filed her answer (Doc. 33) on March 22, 2022 and Defendants Centurion Managed Care and Donna Mendoza filed their answer on June 6, 2022 (Doc. 47).
The Magistrate Judge filed his Report and Recommendation on September 14, 2022 recommending that this action be dismissed without prejudice for Plaintiff's failure to prosecute. In the Report and Recommendation, the Magistrate Judge advised the parties that they had fourteen days from the date of service of a copy of the Report and Recommendation within which to file specific written objections with the Court. The time to file such objections has expired and no objections to the Report and Recommendation have been filed.
The Court finds itself in agreement with the Report and Recommendation of the Magistrate Judge.
IT IS ORDERED adopting the Report and Recommendation of the Magistrate Judge as the Order of this Court.
IT IS FURTHER ORDERED dismissing this case without prejudice.
IT IS FURTHER ORDERED denying as moot Defendants' Motion for Extension of Time to File Motion for Summary Judgment RE Exhaustion of Admirative Remedies (Count 1 Only). (Doc. 58)
IT IS FURTHER ORDERED directing the Clerk to enter judgment accordingly.
