District Court of Appeal of Florida, Fourth District
Jun 29, 1988
526 So. 2d 1083 (Fla. Dist. Ct. App. 1988)

Opinion

No. 87-0609.

June 29, 1988.

Appeal from the Circuit Court for Broward County; Jack Musselman, Judge.

Kenneth V. Hemmerle, Sr., Fort Lauderdale, pro se appellant.

David E. Platte, Clearwater, for appellee-Sunland Properties, Inc.

We reverse. The trial court erred in dismissing appellant's counterclaim where the four corners of the counterclaim did not clearly establish that the issues had previously been adjudicated. Hoke v. Ft. Lauderdale Board of Adjustment, 486 So.2d 698 (Fla. 4th DCA 1986).

REVERSED and REMANDED.

ANSTEAD, GLICKSTEIN and GUNTHER, JJ., concur.
