Hemmerle v. Air Conditioning Equip

District Court of Appeal of Florida, Fourth District
Apr 27, 1994
635 So. 2d 1053 (Fla. Dist. Ct. App. 1994)

Opinion

No. 93-1067.

April 27, 1994.

Appeal from the Circuit Court, Broward County, George A. Brescher, J.

Kenneth V. Hemmerle, pro se.

Jeff M. Brown of Lavalle, Brown Ronan, P.A., Boca Raton, for appellee Air Conditioning Equipment, Inc.

We affirm the trial court's award of attorney's fees to appellee. As the prevailing party in the mechanic's lien action brought under section 713.29, Florida Statutes (1992), appellee is entitled to an award of reasonable attorney's fees. Appellant never appealed the underlying judgment entered in favor of appellee, although he seems to be challenging the validity of that judgment, untimely, in this appeal from the resulting attorney's fees and costs award.

WARNER, POLEN and PARIENTE, JJ., concur.
