IT IS HEREBY STIPULATED by and between the parties hereto, through the undersigned, that the above-captioned action and all claims therein be dismissed with prejudice as to the defendant pursuant to Rule 41, subparagraphs (a)(1)(ii) and (c), of the Federal Rules of Civil Procedure.

The dismissal is being made pursuant to a settlement between the parties.
