MEMORANDUM
Plaintiffs are the wife and children of Charles Hegna, a victim of torture and murder at the hands of members of Hezbollah, a terrorist organization supported by the Republic of Iran. Last year, plaintiffs were awarded a multimillion dollar judgment against Iran. By the present action, plaintiffs seek to prevent the Department of the Treasury from requiring them to relinquish their right to attach properties owned by the Republic of Iran in an effort to satisfy their judgment as a condition of receiving payment from the Government pursuant to the Victims of Trafficking and Violence Protection Act of 2000, Pub.L. No. 106-386, § 2002, 114 Stat 1464, as amended by the Terrorism Risk Insurance Act of 2002, Pub.L. No. 107-297, § 201(c)(4), 116 Stat. 2337.
On July 15, 2003, the court denied plaintiffs' motion for preliminary injunction and indicated that it would set forth its rationale for denying the motion in writing. Upon further consideration, the court has concluded that its rationale for denying the motion is adequately and comprehensively set forth in the defendants' opposition to plaintiffs' motion. Thus, defendants opposition to plaintiffs' motion for a preliminary injunction is adopted by reference as it articulates basis for this court's ruling.
