JUDGMENT VACATED, REMANDED, MANDATE TO ISSUE IMMEDIATELY
This case was submitted on briefs on February 16, 2021. Before this court's opinion and judgment issued, the parties notified this court that they have resolved their dispute and they wish to have their respective claims dismissed. The parties filed a joint agreed motion to (1) vacate the trial court's judgment without regard to the merits, (2) remand the cause to the trial court for it to render orders dismissing the underlying claims in accordance with the parties' agreement, (3) tax appellate costs against the party that incurred them, and (4) issue our mandate immediately.
The parties' joint agreed motion is granted. See Transp. Ins. Co. v. Faircloth, 898 S.W.2d 269, 280 (Tex. 1995) ("Public policy favors the amicable settlement of controversies.").
We vacate the trial court's January 29, 2020 judgment without regard to the merits, and we remand this cause to the trial court for it to render any necessary orders or judgment to dismiss the parties' claims in accordance with the parties' agreements. See TEX. R. APP. P. 41.2(a)(2)(B); Transam. Life Ins. Co. v. J.G. Wentworth Originations, LLC, No. 04-15-00588-CV, 2016 WL 929216, at *1 (Tex. App.-San Antonio Feb. 24, 2016, no pet.) (mem. op.).
We tax costs of court for this appeal against the party that incurred them. Any other pending motions are moot.
We order the clerk of this court to issue the mandate contemporaneously with the issuance of this opinion and judgment. See TEX. R. APP. P. 18.1(c); Dicker v. Nationstar Mortg. LLC, No. 04-20-00221-CV, 2020 WL 4929798, at *1 (Tex. App.-San Antonio July 29, 2020, no pet.) (mem. op.).
