In Re: Kristopher Ray Thomas, applying for supervisory writs, 21st Judicial District Court, Parish of Tangipahoa, No. 2011-0001181.

BEFORE: GUIDRY, THERIOT AND DRAKE, JJ.

WRIT GRANTED IN PART WITH PROTECTIVE ORDER. We reverse the August 6, 2014 judgment of the trial court in part to order Child, Advocacy Services to produce any and all videotaped interviews of ANHT and XHT to the trial judge for an in camera inspection to determine whether the State's interest in maintaining the confidentiality of its investigations into allegations of child abuse is outweighed by the defendant's right to obtain all relevant and admissible evidence. If the trial judge finds that the defendant's interest is the greater interest involved in this civil custody case, the judge shall order Child Advocacy Services to file the videotapes into the record under seal, with a copy provided to counsel. However, Child Advocacy Services employee Joelle Henderson shall not be compelled to testify at trial.
