ORDER


This cause is before the Court on the Motion for Summary Judgment by the United States (Doc. No. 19) filed July 30, 2002, and on the Motion for Summary Judgment by the Plaintiffs (Doc. No. 24) filed August 14, 2002.

The United States Magistrate Judge has submitted an Amended Report recommending that the United States' Motion be denied and that the Plaintiffs' Motion be granted in part and denied in part.

After an independent de novo review of the record in this matter, including the response filed by the Plaintiffs and the objection filed by the Defendant,

It is ORDERED as follows:

1. The Motion for Summary Judgment by the United States (Doc. No. 19) is DENIED.

2. The Motion for Summary Judgment by the Plaintiffs (Doc. No. 24) is DENIED.
