Appeal by defendants from a small claims judgment of the City Court of Poughkeepsie, Dutchess County (R. McGaw, J.), entered May 24, 2004, in favor of plaintiff in the sum of $3,000 plus costs and which dismissed their counterclaim. Judgment unanimously affirmed without costs.

PRESENT: RUDOLPH, P.J., ANGIOLILLO and TANENBAUM, JJ.


Plaintiff instituted this small claims action for the return of a down payment for the purchase of realty. After reviewing the record and the issues raised on appeal, we are satisfied that substantial justice was done between the parties according to the rules and principles of substantive law (UCCA 1807).
