ORDER MODIFYING OPINION AND DENYING PETITION FOR REHEARING; NO CHANGE IN JUDGMENT

ARONSON, J.

It is ordered that the opinion filed herein on October 17, 2008, be modified as follows:

On page 3, the third sentence of the third full paragraph, beginning “MVMV notified H&N” is deleted and the following sentence is inserted in its place:

MVMV notified H&N it would not consent to the assignment of the sub-sublease because “allowing MIMG to bring on a program that would clearly compete with the hospital, and what they told us would really nearly put their physical therapy program out of business, which would make it very difficult for them to function as a medical center.”

This modification does not change the judgment. The petition for rehearing is DENIED.
