Haynes v. State

District Court of Appeal of Florida, Fourth District
Jul 30, 1986
491 So. 2d 622 (Fla. Dist. Ct. App. 1986)

Opinion

No. 85-1998.

July 30, 1986.

Richard L. Jorandby, Public Defender, and Ellen Morris, Asst. Public Defender, West Palm Beach, for appellant.

Jim Smith, Atty. Gen., Tallahassee, and Amy Diem, Asst. Atty. Gen., West Palm Beach, for appellee.

We affirm the conviction and sentence, but reverse as to the costs imposed. The costs were imposed without following the dictates of Jenkins v. State, 444 So.2d 947 (Fla. 1984), and thus we reverse for a hearing on costs to be imposed on the appellant.

AFFIRMED IN PART; REVERSED IN PART.

DOWNEY and GLICKSTEIN, JJ., concur.
