JAMES HOWARD HAYES, JR., Appellant, v. THE STATE OF NEVADA, Respondent.

UNPUBLISHED OPINION

ORDER DISMISSING APPEAL

James Howard Hayes, Jr., appeals from an order of the district court denying a "motion for credit, presentence confinement served; applied to sentence" filed on August 10, 2022. Eighth Judicial District Court, Clark County; Monica Trujillo, Judge.

Because no statute or court rule permits an appeal from an order denying a "motion for credit, presentence confinement served; applied to sentence," this court lacks jurisdiction to consider this appeal. See Castillo v. State, 106 Nev. 349, 352, 792 P.2d 1133, 1135 (1990) ("We have consistently held that the right to appeal is statutory; where no statutory authority to appeal is granted, no right to appeal exists."). Accordingly, we

ORDER this appeal DISMISSED.

Gibbons, C.J., Bulla, J., Westorook, J.

Hon. Monica Trujillo, Distinct Judge.
