Hayes v. Long Island Game Farm, Inc.

Appellate Division of the Supreme Court of New York, Second Department
Dec 6, 2000
278 A.D.2d 200 (N.Y. App. Div. 2000)

Opinion

Submitted November 15, 2000.

December 6, 2000.

In an action to recover damages for personal injuries, the defendant appeals from so much of an order of the Supreme Court, Queens County (Golia, J.), dated April 6, 2000, as denied its cross motion for summary judgment dismissing the complaint.

Greenfield Hastings, Jericho, N.Y. (Michael T. Reilly of counsel), for appellant.

Andrea Towsky, Garden City, N.Y. (Toby S. DeSimone of counsel), for respondent.

Before: CORNELIUS J. O'BRIEN, J.P., THOMAS R. SULLIVAN, GABRIEL M. KRAUSMAN, GLORIA GOLDSTEIN, ROBERT W. SCHMIDT, JJ.

DECISION ORDER

ORDERED that the order is affirmed insofar as appealed from, with costs.

There are questions of fact which preclude the granting of summary judgment (see, Zuckerman v. City of New York, 49 N.Y.2d 557).
