Before the Court are (1) appellant's June 20, 2024 motion to release evidence and (2) court reporter Jennifer A. Jacobs's June 20, 2024 request for an extension of time to file the reporter's record. In his motion, appellant asserts appellee "willfully withheld" evidence requested to be shared in the underlying proceeding and requests that evidence-the "Unedited Video and Unedited Written transcript" of appellant's deposition-be filed with the Court and a copy provided to appellant. Ms. Jacobs requests a sixty-day extension of time and explains it is necessary based on "an additional two years' worth of Reporter's Record" appellant has requested.
As to appellant's motion, we note that the Court can consider only documents formally included in the record on appeal. See Sink v. Sink, 364 S.W.3d 340, 345 (Tex. App.-Dallas 2012, no pet.). Accordingly, we DENY this motion.
As to Ms. Jacobs's request, we GRANT the request and ORDER Ms. Jacobs to file the record no later than August 29, 2024.
