MEMORANDUM OPINION


In this case, a jury found Tim Hawthorne guilty of driving while intoxicated. See Tex. Pen. Code Ann. § 49.04 (Vernon 2003). Punishment was assessed at 180 days in the county jail, probated for twenty-four months, and a $1500 fine. Based on the trial court's findings, we concluded appellant abandoned the appeal and submitted the appeal without the reporter's record and briefs. See Tex.R.App.P. 37.3(c), 38.8(b)(4). Absent briefs, no points of error are before us. Finding no fundamental error, we affirm the trial court's judgment.
