Opinion

No. 330 2013.

2013-07-25

Donnie HAWKINS, Defendant Below–Appellant, v. STATE of Delaware, Plaintiff Below–Appellee.

Court Below—Superior Court of the State of Delaware in and for Sussex County, Cr. ID No. 0411002216A.

ORDER

CAROLYN BERGER, Justice.

This 25th day of July 2013, it appears to the Court that, on June 24, 2013, the Clerk issued a notice to show cause why this appeal should not be dismissed pursuant to Supreme Court Rule 29(b) for this Court's lack of jurisdiction to entertain an appeal from an informational letter from the Superior Court. The appellant has failed to respond to the notice to show cause within the required 10–day period. Therefore, dismissal of this action is deemed to be unopposed.

On July 5, 2013, the appellant informed the Clerk that he wished to withdraw his appeal, but has failed to file a motion to withdraw with prejudice, as requested by the Clerk on that same date.

NOW, THEREFORE, IT IS ORDERED, pursuant to Supreme Court Rule 29(b), that this appeal is DISMISSED.
