Order granting defendant's motion to dismiss complaint on the ground that it fails to state facts sufficient to constitute a cause of action unanimously affirmed, with twenty dollars costs and disbursements, with leave to the plaintiff to serve an amended complaint within twenty days after service of order upon payment of said costs and ten dollars costs of motion awarded at Special Term. No opinion.
