Before the Court are appellant's March 20, 2024 (1) motion for an extension of time to challenge the trial court's March 6, 2024 order to pay court costs and (2) motion challenging that order. We GRANT appellant's extension motion. The motion challenging the order is deemed timely filed.
On January 4, 2024, appellant (1) filed in the trial court a Statement of Inability to Pay Court Costs reflecting that she receives public benefits and (2) requested a hearing on thereon. The following day, the trial court clerk informed appellant by email that the trial court had denied her request for a hearing. Our records do not show, and the trial court's website does not indicate, that the Statement of Inability was challenged. See Tex. R. Civ. P. 145(e) (setting forth who and how a statement of inability may be challenged). Nevertheless, on March 6, 2024, the trial court signed an order denying appellant's uncontested Statement of Inability. Because the Statement of Inability was not challenged, and no hearing was conducted, the record does not contain any evidence to support the trial court's order. Accordingly, we reverse the trial court's March 6, 2024 order. We ORDER Collin County Clerk Stacey Kemp and Official Court Reporter Shawn Gant to file their respective records on or before April 24, 2024 without payment of costs.
