This case is currently set for trial at the Court's April 3, 2023, Miami, Florida trial session. On March 10, 2023, respondent filed a Motion to Dismiss for Lack of Jurisdiction as to Taxable Year 2021, a Motion for Leave to File Motion for Continuance out of time and lodged a Motion for Continuance. By Order dated March 15, 2023, we granted respondent's Motion for Leave and filed the Motion for Continuance. Petitioner was directed to respond to the Motion for Continuance and Motion to Dismiss by March 27, 2023. To date we have not received a response from petitioner. Upon due consideration and for cause, it is hereby

ORDERED that respondent's Motion for Continuance, filed March 15, 2023, and Motion to Dismiss for Lack of Jurisdiction as to Taxable Year 2021, filed March 10, 2023, are set for hearing at the Court's Miami, Florida trial session, scheduled to commence on April 3, 2023, at 10:00am EDT in Room 1524, Claude Pepper Federal Building, 51 S.W. 1st Avenue, Miami, FL 33130.
