This case is currently set for trial at the Court's April 3, 2023, Miami, Florida trial session. On March 10, 2023, respondent filed a Motion to Dismiss for Lack of Jurisdiction as to Taxable Year 2021, a Motion for Leave to File Motion for Continuance out of time and lodged a Motion for Continuance. Upon due consideration and for cause, it is hereby

ORDERED that respondent's Motin for Leave to File Motion for Continuance, is granted, and the Motion for Continuance, lodge March 10, 2023, is filed as of the date of this Order. It is further

ORDERED that petitioner shall, on or before March 27, 2023, file a response to respondent's Motion for Continuance and Motion to Dismiss for Lack of Jurisdiction as to Taxable Year 2021.
