REPORT AND RECOMMENDATION


This cause is before the court upon referral from the clerk. Plaintiff initiated this action through the filing of a civil rights complaint and motion to proceed in forma pauperis. Permission to proceed in forma pauperis was granted (doc. 7) and plaintiff was ordered to correct the deficiencies in his complaint. The court's order was returned as undeliverable and the clerk was directed to mail another copy of the order to plaintiff at Franklin Correctional Institute and he was given an additional thirty (30) days to file an amended complaint. After receiving no response from plaintiff, an order to show cause issued giving plaintiff twenty (20) days to show cause why the case should not be dismissed (doc. 12). However, there has still been no response from plaintiff to date.

Accordingly, it is respectfully RECOMMENDED:

That this case be dismissed for failure to prosecute and failure to comply with an order of the court.
