GRACE LYN HARVEY, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 382nd Judicial District Court Rockwall County, Texas Trial Court Cause No. 24-0034-382-F

ORDER

NANCY KENNEDY JUSTICE

We REINSTATE this appeal.

We abated this appeal for the trial court to hold a hearing and make findings whether appellant was indigent. The trial court made a finding that appellant is indigent and is unable to afford to pay for the appellate record or to pay for an attorney on appeal. The trial court also found that appellant refused appointment of counsel to represent her on appeal and that she desires to represent herself. We accept the trial court's findings.

Appellant's October 29, 2024 motion for extension of time to file the reporter's record is GRANTED. We ORDER court reporters Linda Maddox and Sue Ann Toney to file the reporter's record on or before DECEMBER 19, 2024.

Appellant's brief will be due THIRTY DAYS after the reporter's record is filed. Appellant's brief must comply with the Texas Rules of Appellate Procedure, including Rules 9.1 through 9.10 and Rule 38.1.

We DIRECT the Clerk to send copies of this order to Linda Maddox, Official Court Reporter, 382nd District Court; Sue Ann Toney, Court Reporter; Appellant; and counsel for all parties.
