Harvey v. Harvey

Appellate Division of the Supreme Court of New York, Second Department
Dec 7, 1942
265 App. Div. 939 (N.Y. App. Div. 1942)

Opinion

December 7, 1942.

In an action for a separation, order, made on plaintiff's motion, awarding her additional counsel fee to defend an appeal from an order, modified on the facts by substituting the amount "$50.00" in place of "$150.00." As thus modified, the order is affirmed, without costs, the counsel fee to be paid within ten days from the entry of the order hereon. The award is excessive in relation to the nature and extent of the services and the amount of the defendant's income. Lazansky, P.J., Hagarty, Johnston, Adel and Taylor, JJ., concur.
