308 So. 3d 222 (Fla. Dist. Ct. App. 2020)

Opinion

No. 1D20-2794

11-04-2020

Scott HARTMAN, Appellant, v. FLORIDA DEPARTMENT OF CORRECTIONS, Appellee.

Scott Hartman, pro se, Appellant. Lance Eric Neff, General Counsel, and Beverly Brewster, Assistant General Counsel, Department of Corrections, Tallahassee, for Appellee.

Scott Hartman, pro se, Appellant.

Lance Eric Neff, General Counsel, and Beverly Brewster, Assistant General Counsel, Department of Corrections, Tallahassee, for Appellee.

Per Curiam.

Upon consideration of Appellant's response to the Court's order of September 29, 2020, the Court has determined that the notice of appeal was not timely filed. Because this is a civil matter, Appellant's request that the Court grant him a belated appeal is denied. See Powell v. State Dept. of Corrections , 727 So. 2d 1103 (Fla. 1st DCA 1999). Accordingly, the appeal is dismissed.

Jay, M.K. Thomas, and Nordby, JJ., concur.
