On April 30, 2021, the parties filed a joint status report in this case requesting that this case be calendared on the Court's November 15, 2021, Phoenix, Arizona, trial session, solely to enable the parties to issue subpoenas returnable at that hearing. The Court has scheduled special hearing sessions each Wednesday specifically for the return of third-party subpoenas. The parties have agreed to have the case added to the September 29, 2021, session in consideration of the foregoing, it is
ORDERED that this case is scheduled for hearing at the Court's September 29, 2021, Washington, D.C., special hearing to be conducted remotely at a time certain of 1:00 p.m. (Eastern Time) on Wednesday, September 29, 2021, at which time any third-party subpoenas may be returnable. Special Trial Judge Leyden will preside at this hearing. If all subpoenaed parties supply all subpoenaed documents to the requesting party in advance of the hearing, the hearing will be cancelled. ORDERED that the Clerk of the Court shall serve on the parties a Notice of Remote Proceeding that shall contain comprehensive instructions on how to participate in the above-referenced remote proceeding. It is further
ORDERED that, no later than September 28, 2021, the parties shall file a status report advising the Court whether all third parties have complied with all subpoenas, so that a hearing is no longer necessary.
