NOTICETO POTENTIAL PLAINTIFFS
TO: Individuals that are or have been employed by GEICO in the Commonwealth of Pennsylvania as Region 1 Automobile and/or Residential and/or Catastrophic Adjusters between May 27, 2019 and May 27, 2022.
RE: Your Right to Join a Lawsuit Seeking Unpaid Overtime Wages.
What is the Lawsuit?
CIVIL ACTION NO. 4:21-CV-00859 is a lawsuit filed in the United States District Court for Middle District of Pennsylvania by Susan Hart (“Plaintiffs”) against GEICO on behalf of current and former Region 1 Automobile and/or Residential Adjusters and/or Catastrophic Adjusters I, II, and III employed within the Commonwealth of Pennsylvania for unpaid overtime wages, and damages.
All current and former employees who work or worked for GEICO within the Commonwealth of Pennsylvania as Region 1 Automobile and/ or Residential Adjusters and/or Catastrophic Adjusters at any time between May 27, 2019 and May 27, 2022, who were not paid overtime wages at the time-and-one-half rate for all overtime worked over forty (40) hours per week are being given an opportunity to join the lawsuit.
GEICO denies any liability. GEICO claims Plaintiff is not owed wages or damages.
The Court expresses no view as to who should win the lawsuit at this time.
What is at Stake and When Must I Act?
By submitting a Consent Form, you may be considered by the Court as a plaintiff and/or party to the lawsuit. As such, you may be required to participate in or respond to discovery in the case.
If the Court finds that you should have been and were not paid overtime compensation, the Court may award you money damages.
To join the lawsuit, the enclosed consent form must be signed and filed with the Court no later than May 27, 2022. Please try to send it at least 14 days early to allow for processing.
FEDERAL LAW PROHIBITS GEICO FROM RETALIATING AGAINST YOU BECAUSE YOU JOIN THE LAWSUIT.
What if I do not join the lawsuit?
You receive no recovery in the lawsuit if you do not join. However, you are under no obligation to join.
How do I join the lawsuit?
To join the lawsuit, complete the enclosed consent form and mail or fax it to Plaintiff's attorneys at the address specified below.
The signed consent form must be filed with the Court no later than May 27, 2022, so please allow at least at least 14 days for processing.
You are not a member of the lawsuit until the form is filed.
You are eligible to file a consent and seek to join the lawsuit EVEN IF you signed a waiver and release of claims.
