On November 8, 2023, appellant filed his appellant's brief. The brief does not comply with Rules 9.4, 9.5, or 38.1 of the Texas Rules of Appellate Procedure. See Tex. R. App. P. 9.4, 9.5, 38.1. Specifically, the brief violates Texas Rule of Appellate Procedure 9.4 because it does not contain a certificate of compliance. See id R. 9.4(i)(3). The brief also violates Texas Rule of Appellate Procedure 9.5 because it does not certify that appellant served the brief on appellees. See id. R 9.5(a), (d), (e). Finally, the brief violates Texas Rule of Appellate Procedure 38.1 because it does not contain: (1) a statement of facts that is "supported by record references" and "state[s] concisely and without argument the facts pertinent to the issues or points presented"; (2) "a clear and concise argument for the contentions made, with appropriate citations to authorities and to the record"; or (3) an appendix containing a copy of "the trial court's judgment or other appealable order from which relief is sought[.]" See id. R 38.1(g), (i), (k).
Accordingly, we ORDER appellant's brief STRICKEN and ORDER appellant to file an amended brief in this court complying with Rules 9.4, 9.5, and 38.1 by December 13, 2023. If appellant does not timely file an amended brief, this appeal will be dismissed for want of prosecution. See Tex. R App. P. 38.9, 42.3.
