District Court of Appeal of Florida, Fifth District
Mar 18, 1994
633 So. 2d 574 (Fla. Dist. Ct. App. 1994)

Opinion

No. 93-362.

March 18, 1994.

Appeal from the Circuit Court for Brevard County; Martin Budnick, Judge.

James B. Gibson, Public Defender, and Susan A. Fagan, Asst. Public Defender, Daytona Beach, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Robin Compton Jones, Asst. Atty. Gen., Daytona Beach, for appellee.

We affirm appellant's judgment and sentence, but correct a scrivener's error in the judgment to reflect that appellant was convicted of a first degree felony rather than a first degree felony punishable by life.

AFFIRMED AS CORRECTED.

DAUKSCH, COBB and GOSHORN, JJ., concur.
