RICHARD HARRIS, Plaintiff, v. WARDEN SMITH, et al., Defendants.

REPORT AND RECOMMENDATION

This prisoner civil rights case is before the court upon referral from the clerk. On May 15, 2017, the court ordered plaintiff to submit, within 30 days, the $350.00 filing fee and $50.00 administrative fee, or, alternatively, a new prisoner consent form accompanied by a copy of plaintiff's inmate trust account statement for the period November 9, 2016, through May 9, 2017. (Doc. 3). Plaintiff was warned that failure to do so would result in dismissal of this case. (Id.). To date, plaintiff has not complied with the order and has not responded to the June 21, 2017, order (doc. 4) requiring him to show cause, within 14 days, why this case should not be dismissed for failure to comply with an order of the court.

Accordingly, it is respectfully RECOMMENDED:

1. That this case be DISMISSED WITHOUT PREJUDICE for plaintiff's failure to comply with an order of the court.

2. That the clerk be directed to close the file.

At Pensacola, Florida this 17th day of July, 2017.
