  1. Sanchez-Sifonte v. Fonseca

    CIVIL 22-1444 (RAM) (D.P.R. Nov. 26, 2024)

Defamation, including libel and slander, is defined as "a false and unprivileged publication of unfounded statements that injure a person." Harris v. Plapp, 386 So.3d 185, 189 (Fla. Dist. Ct. App. 2022) (quoting Delacruz v. Peninsula State Bank, 221 So.2d 772, 775 (Fla. Dist. Ct. App. 1969)). The Florida Supreme Court has held that a successful defamation claim requires: "(1) publication; (2) falsity; (3) actor must act with knowledge or reckless disregard as to the falsity on a matter concerning a public official, or at least negligently on a matter concerning a private person; (4) actual damages; and (5) statement must be defamatory."
